After reading a headline today – “James Babe Shot and Killed During Alleged Home Burglary in Town of Oconomowoc” – I had to do a little research since I was curious of two things. One was, where the heck is Oconomowoc ? The other was what is the difference between Home Burglary and Home Invasion Robbery?
The first answer was a little easier to find. Oconomowoc is in Wisconsin about 30 miles west of Milwaukee. Now you know!
As for the difference between a Home Burglary and a Home Invasion, that was a little more difficult to get a real straight answer. There are a lot of differing opinions out there. Here are the basics of what I could find: A home burglary is when the home is vacant and the burglar is unarmed. A home invasion is when a “(2) A person who breaks and enters a dwelling with intent to commit a felony, larceny, or assault in the dwelling, a person who enters a dwelling without permission with intent to commit a felony, larceny, or assault in the dwelling, or a person who breaks and enters a dwelling or enters a dwelling without permission and, at any time while he or she is entering, present in, or exiting the dwelling, commits a felony, larceny, or assault is guilty of home invasion in the first degree if at any time while the person is entering, present in, or exiting the dwelling either of the following circumstances exists:
(a) The person is armed with a dangerous weapon.
(b) Another person is lawfully present in the dwelling.”
So after reading this I’m thinking that it was possibly a Home Invasion and not a burglary since he was armed. There are different degrees of home invasion.
Home invasions are occurring more often these days. Burglars are getting more desperate and bold.
